Terms of Service

These Terms of Service ("Terms") govern your use of Depth — the website, application, and related services operated by Raghav Dua and Prithvish Baidya ("Depth", "we", "us", "our"). Depth is the intelligence layer for your body: you upload your blood-test reports, we read and score them, and we hand back insights and an AI agent that answers questions over your own health record. Please read these Terms carefully. The medical disclaimer in section 6 is especially important.

1. Acceptance of these Terms

By creating an account or using Depth, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

2. What Depth is

Depth lets you upload blood-test report PDFs. We parse them, extract your biomarkers, generate a Depth Score and an insight Recap, and provide an AI agent that answers questions across your record. Wearable and continuous-glucose integrations and at-home blood draws are on our roadmap and may be added over time. The Service is informational and wellness-oriented. It is not a medical service. See section 6.

3. Eligibility

You must be at least 18 years old to use Depth. By using the Service, you confirm that you are 18 or older and legally able to enter into these Terms. Depth is not intended for, and may not be used by, anyone under 18.

4. Your account and Google sign-in

You create your account using Google sign-in. You are responsible for keeping access to your Google account secure, and for everything that happens under your Depth account. Tell us promptly if you believe your account has been accessed without your permission. The information you give us must be accurate, and you may not impersonate anyone else or create an account on someone else's behalf.

5. Acceptable use

You agree not to:

  • Upload data that is not yours, or that you have no right to share with us.
  • Use the Service to break the law, or to harm, harass, or infringe the rights of others.
  • Reverse engineer, scrape, overload, probe, or interfere with the Service or its security.
  • Resell, sublicense, or commercially exploit the Service or its output without our written permission.
  • Misrepresent Depth's output as medical advice or a clinical diagnosis to anyone, including yourself.

6. Medical disclaimer — please read

Depth is not a medical device. It does not provide medical advice, diagnosis, or treatment. The Depth Score, insights, Recaps, and AI agent are for informational and wellness purposes only. They are not a substitute for professional medical care, and nothing in the Service creates a doctor–patient relationship.

Always seek the advice of a qualified clinician about your health and before making any decision based on what Depth shows you. Never disregard professional medical advice, or delay seeking it, because of something you read in Depth. Depth does not replace lab interpretation by a licensed professional, and our outputs may be incomplete or wrong. If you think you may have a medical emergency, contact your doctor or local emergency services immediately.

7. Your uploads and the license you give us

You keep ownership of the reports and data you upload. To run the Service, you grant us a limited, non-exclusive, worldwide license to host, store, process, and analyze your uploads and the data derived from them — including sending the contents of your reports to our processors for AI extraction, and generating your scores, insights, and Recaps. This license exists only to provide the Service to you and ends when you delete the relevant data or close your account, subject to limited retention required by law. We describe exactly who processes your data, and where it is stored, in our Privacy Policy.

8. Our intellectual property

The Service itself — the software, the Depth Score methodology, the Recap format, our models, designs, text, and the Depth name and brand — belongs to us or our licensors and is protected by intellectual-property law. These Terms do not give you any right to use our brand or content except to use the Service as intended. The personalized output we generate for you is yours to use for your own purposes.

9. Third-party services

Depth relies on third parties to operate — including Cloudflare for hosting and storage, PlanetScale for our database, Google Cloud for sign-in and report processing, and NVIDIA for the model that writes insight copy. These providers have their own terms, and we are not responsible for their services. Our use of them is described in our Privacy Policy.

10. Subscriptions and fees

Some features of the Service may be offered free of charge, and others may require a paid subscription or one-time fee. Where fees apply, the price, billing cycle, and any renewal or cancellation terms will be presented to you before you are charged, and you agree to pay them. Unless the law requires otherwise or we say so at the time, fees are non-refundable. We may change our pricing on a going-forward basis with reasonable notice.

11. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that its output will be accurate, complete, or suitable for any particular purpose — including any health or medical purpose. You use the Service, and rely on its output, at your own discretion and risk.

12. No liability

The Service is provided "as is", and you use it entirely at your own risk. To the fullest extent permitted by law, Depth and its operators (Raghav Dua and Prithvish Baidya) are not liable to you or to anyone else for any damages of any kind whatsoever — including any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, any loss of data, profits, savings, or goodwill, and any harm arising from actions taken on the basis of the Service — arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. You are solely responsible for any decisions you make using Depth. Nothing here excludes liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Depth and its operators from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or the rights of any third party.

14. Termination

You may stop using Depth and close your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service. On termination, your right to use the Service ends; the sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) will continue to apply. How we handle your data on account closure is set out in our Privacy Policy.

15. Changes to these Terms

We may update these Terms as the Service evolves. When we make a material change, we will update the effective date above and, where appropriate, notify you. Your continued use of the Service after a change takes effect means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws rules. You agree that the courts located in Bangalore, India, India, will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you submit to the personal jurisdiction of those courts.
